  • Permitted Purpose: the ability to stipulate how the Hirer is allowed to use the relevant area;
  • Time: the days or hours that the premises will be available;
  • Fees: The applicable licence fees;
  • Cancellation or Rescheduling: a right for both parties to cancel or reschedule. However, if the Hirer needs to cancel or reschedule, then they are required to give written notice and may need to pay a rescheduling or cancellation fee.
  • Termination: A right for the Studio to terminate the arrangement if the Hirer breaches the agreement
  • Inclusions: Any applicable Inclusions
  • Obligations: The obligations of the Hirer include keeping the relevant area in good condition; complying with certain WHS standards; and maintaining insurance; and
  • Confidentiality: that both parties keep the other party’s confidential information, confidential.

  • If you are leasing the premises from someone else, PLEASE check the terms of your lease! There might be restrictions on sub-leasing. If a restriction is in place, you will want to ensure that you get the Landlords consent to this arrangement before you go down this path. It Is always best practice to obtain consent or you might find yourself In breach of the lease agreement.
  • Please ensure that you read the terms carefully to make sure that they clearly reflect the commercial arrangement you have made.
  • It Is extremely important that the Hirer brings their own equipment, manages their own finances and marketing. Basically, they must be their own boss – running their own business to classify as a freelancer / contractor. This links to the point below.

    If the Studio is using this kind of arrangement as a way to avoid paying payroll costs like leave entitlements or wages, then legal issues can arise and the Hirer may be classified as an employee. Please make sure you obtain appropriate legal advice If you have any concerns about this.
